1. Acceptance of Terms

By accessing or using the services provided by Johnson Property Management ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Provided

Johnson Property Management provides residential and commercial property management services in the San Diego metropolitan area, including but not limited to:

  • Tenant screening and placement
  • Rent collection and disbursement
  • Property maintenance coordination
  • Financial reporting and accounting
  • Lease preparation and enforcement
  • Move-in and move-out inspections
  • Eviction proceedings support

3. Management Agreement

All property management services are governed by a separate written Management Agreement signed between the property owner and Johnson Property Management. These Terms and Conditions are supplemental to and incorporated into that agreement. In the event of a conflict, the Management Agreement shall control.

4. Owner Responsibilities

Property owners engaging our services agree to:

  • Provide accurate and complete information about the property
  • Maintain adequate property insurance at all times
  • Fund a reserve account as specified in the Management Agreement
  • Comply with all applicable federal, state, and local laws
  • Authorize Johnson Property Management to act as agent for the property as outlined in the agreement

5. Fees and Payment

Management fees, leasing fees, and any other charges are outlined in the Management Agreement. Fees are subject to change with 30 days' written notice. All fees are exclusive of applicable taxes unless otherwise stated.

6. Owner Protection Program

The Owner Protection Program benefits — including tenant damage coverage up to $3,500, eviction protection up to $3,000, and the money-back guarantee — are subject to the specific terms, conditions, and limitations set forth in the Management Agreement. Coverage applies only during active management by Johnson Property Management.

7. Limitation of Liability

To the fullest extent permitted by law, Johnson Property Management shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the provision of property management services, including but not limited to loss of revenue, loss of profits, or property damage not caused by our negligence.

Our total liability for any claim arising under these Terms shall not exceed the total management fees paid by you in the three months preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify and hold harmless Johnson Property Management, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your property, your breach of these Terms, or your violation of any applicable law or regulation.

9. Termination

Either party may terminate the Management Agreement in accordance with the notice and termination provisions contained therein. Upon termination, Johnson Property Management will provide a final accounting and transfer all property-related funds and documents within the timeframe specified in the agreement.

10. Governing Law

These Terms and Conditions are governed by the laws of the State of California. Any disputes arising under these Terms shall be resolved in the courts of San Diego County, California, and you consent to the personal jurisdiction of such courts.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or written notice to you. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
